Diritto di recesso

1. Il diritto di recesso non è applicabile ai prodotti o beni confezionati su misura o personalizzati perché questi sono realizzati appositamente per il cliente.

2. Per i prodotti in pronta consegna, ai sensi dell’art. 52 del D. Lgs. 206/2005, così come modificato dal D.Lgs. 21/2014, il Cliente potrà recedere dalle Condizioni e pertanto dal contratto di acquisto per qualsiasi motivo, senza necessità di addurre motivazioni e senza alcuna penalità, entro 14 (quattordici) giorni lavorativi dalla data di ricevimento dei prodotti.

3. Per esercitare il diritto di recesso di cui al precedente articolo 5.1, Cliente dovrà inviare a Paul.hide S.n.c. una comunicazione in tal senso, entro i termini indicati, al seguente indirizzo email [email protected].

4. In caso di recesso il Cliente dovrà reinviare a sue spese i prodotti a Paul.hide S.n.c. entro 14 (quattordici) giorni dal recesso medesimo, al seguente indirizzo Paul.hide S.n.c. di Paoletta E. & Florean G. S.n.c. , con sede in Via Giorgione, 4 – 30021 Caorle (VE).

In questo caso verrà richiesto un contributo alle spese di spedizione per la restituzione dei prodotti acquistati.

La merce dovrà essere restituita integra, completa di tutte le sue parti e negli imballi originali (buste e confezioni), custodita ed eventualmente adoperata per il tempo strettamente necessario per stabilirne e verificarne natura, caratteristiche e taglia, secondo la normale diligenza, senza che vi siano segni di usura o sporcizia, nel rispetto delle condizioni di seguito riportate:

• il diritto di recesso potrà applicarsi al prodotto acquistato nella sua interezza; non è infatti possibile esercitare recesso solamente su parte del prodotto acquistato (es.: accessori, complementi, ecc…);
• perché il recesso sia possibile, il prodotto dovrà essere integro e restituito nella confezione originale, completa in tutte le sue parti (compresi imballo ed eventuale documentazione e dotazione accessoria: etichette, cartellini, tags, sigilli, ecc…);
• le spese di spedizione(ed eventuali spese doganali, se presenti) per la restituzione del bene saranno ad esclusivo carico del Cliente.
• la spedizione, fino all’attestato di avvenuto ricevimento nel magazzino indicato da Paul.hide S.n.c., è sotto la completa responsabilità del cliente;
• in caso di danneggiamento del bene durante il trasporto, Paul.hide S.n.c. ne darà comunicazione al Cliente, per consentirgli di sporgere tempestivamente denuncia nei confronti del corriere da lui scelto ed ottenere il relativo rimborso; il prodotto sarà quindi messo a disposizione del Cliente, contemporaneamente annullando la richiesta di recesso;
• Paul.hide S.n.c. non risponderà in nessun modo per danneggiamento, furto, smarrimento occorsi durante o comunque in dipendenza della spedizione per la restituzione.

5. Paul.hide S.n.c. provvederà a rimborsare al Cliente l’intero importo già pagato, al netto degli eventuali costi supplementari di spedizione ai sensi dell’art. 56, comma 2, del D. lgs. 21/14, entro 14 (quattordici) giorni dal recesso, tramite procedura di storno dell’importo addebitato, utilizzando lo stesso mezzo di pagamento utilizzato dal Cliente per la transazione iniziale, salvo diverso accordo. In ogni caso, il Cliente non sosterrà alcun costo quale conseguenza di detto rimborso tranne le spese di spedizione (ed eventuali spese doganali, se presenti) per la restituzione del bene che resteranno ad esclusivo carico del Cliente. Qualora il cliente lo desideri, può seguire le istruzioni per prenotare il ritiro del reso agevolato, il cui costo di spedizione verrà addebitato direttamente in sede di rimborso. In Tale ultimo caso, Paul.hide S.n.c. si farà carico di eventuali spese doganali, per la restituzione del bene. Paul.hide S.n.c. potrà sospendere il rimborso sino al ricevimento del prodotto restituito ovvero sino al momento in cui il Cliente dimostri di aver correttamente rispedito il prodotto, se precedente.

6. In ogni caso, il Cliente decadrà dal diritto di recesso nei casi in cui Paul.hide S.n.c. accerti che:

• il prodotto restituito e/o i suoi accessori, e/o la sua confezione non sono integri;
• il prodotto è mancante della sua confezione esterna e/o dell’imballo interno originale;
• il prodotto è mancante di elementi integranti lo stesso e/o accessori (ad. Es. chiusure, lacci, fibbie, ecc.).

Nel caso di decadenza del diritto di recesso, Paul.hide S.n.c. provvederà a restituire al mittente il prodotto acquistato, addebitando allo stesso le spese di spedizione e, ove già rimborsato, il prezzo del prodotto.

Consegna dei prodotti e relative spese

1. I prodotti in pronta consegna acquistati verranno spediti all’indirizzo indicato dal Cliente nell’Ordine entro 24-72 ore dall’accettazione dell’Ordine da parte di Paul.hide S.n.c. , al costo indicato specificamente nel Sito prima dell’invio dell’Ordine. Paul.hide S.n.c. si riserva la facoltà di accettare o meno consegne richieste fuori dai confini italiani o europei. In ogni caso, per consegne da eseguirsi fuori dai confini italiani, le spese di spedizione ed i tempi di consegna potrebbero subire variazioni.

2. Relativamente alle consegne richieste in paesi non appartenenti all’Unione Europea, eventuali spese doganali di importazione saranno a carico del destinatario. Si invita pertanto il Cliente a contattare preventivamente le autorità doganali del proprio paese per verificare i costi e gli eventuali limiti di importazione.

3. I tempi di consegna indicati da Paul.hide S.n.c. devono considerarsi come puramente indicativi ed un ritardo rispetto agli stessi, ovvero l’eventuale consegna effettuata con successive spedizioni frazionate non legittimano il Cliente al rifiuto della consegna medesima ed alla richiesta di risarcimenti o indennizzi.

4. Al momento della consegna dei prodotti, il Cliente è tenuto a controllare:

• che il numero dei colli in consegna corrisponda a quanto indicato nel documento di trasporto.
• che l’imballo risulti integro, non danneggiato, né bagnato o comunque alterato, anche nei materiali di chiusura (nastro adesivo o reggette metalliche).

Eventuali danni all’imballo e/o al prodotto o la mancata corrispondenza del numero dei colli o delle indicazioni, dovranno essere immediatamente rilevati, apponendo una specifica indicazione sul documento di consegna del prodotto da riconsegnarsi al corriere.
Eventuali problemi inerenti l’integrità fisica, la corrispondenza o la completezza dei prodotti ricevuti devono essere segnalati entro 7 giorni dalla avvenuta consegna.

Right of withdrawal

1. The right of withdrawal is not applicable to products or goods made to measure or customized because these are made specifically for the customer.

2. For products ready for delivery, pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to give reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.

3. To exercise the right of withdrawal referred to in article 5.1 above, the Customer must send Paul.hide S.n.c. a communication to this effect, within the terms indicated, to the following email address [email protected].

4. In case of withdrawal, the Customer must return the products to Paul.hide S.n.c. at his own expense. within 14 (fourteen) days from the withdrawal itself, to the following address Paul.hide S.n.c. by Paoletta E. & Florean G. S.n.c. , with headquarters in Via Giorgione, 4 – 30021 Caorle (VE).

In this case, a contribution to the shipping costs will be required for the return of the purchased products.

The goods must be returned intact, complete with all its parts and in the original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without are signs of wear or dirt, in compliance with the following conditions:

the right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the purchased product (eg: accessories, complements, etc …);
for the withdrawal to be possible, the product must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, seals, etc …);
the shipping costs (and any customs fees, if any) for returning the goods will be the sole responsibility of the Customer.
the shipment, until the certificate of receipt in the warehouse indicated by Paul.hide S.n.c., is under the complete responsibility of the customer;
in case of damage to the goods during transport, Paul.hide S.n.c. will notify the Customer, to allow him to promptly file a complaint against the courier he has chosen and obtain the relative reimbursement; the product will then be made available to the customer, simultaneously canceling the request for withdrawal;
Paul.hide S.n.c. will not be liable in any way for damage, theft, loss occurring during or in any case depending on the return shipment.

5. Paul.hide S.n.c. will refund the customer the full amount already paid, net of any additional shipping costs pursuant to art. 56, paragraph 2, of the Legislative Decree 21/14, within 14 (fourteen) days of withdrawal, by means of a reversal of the amount charged, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not incur any costs as a consequence of said reimbursement except the shipping costs (and any customs fees, if any) for the return of the goods which will remain the sole responsibility of the Customer. If the customer so wishes, he can follow the instructions to book the collection of the facilitated return, the shipping cost of which will be charged directly during the refund. In the latter case, Paul.hide S.n.c. will be responsible for any customs fees for returning the goods. Paul.hide S.n.c. may suspend the refund until the returned product is received or until the Customer proves that he has correctly returned the product, if earlier.

6. In any case, the Customer will lose the right of withdrawal in cases where Paul.hide S.n.c. make sure that:

the returned product and / or its accessories, and / or its packaging are not intact;
the product is missing its external packaging and / or original internal packaging;
the product lacks integral elements and / or accessories (eg closures, laces, buckles, etc.).

In case of forfeiture of the right of withdrawal, Paul.hide S.n.c. will return the purchased product to the sender, debiting the shipping costs and, if already refunded, the price of the product.
